Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Fynstream platform, website, and related services (collectively, the "Service") provided by Fynstream ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

2.1 Why we verify

Every new account must pass a manual verification review before publishing, uploading, or multistreaming. Verification protects our network from abuse (copyright infringement, spam, fraud, prohibited content) and keeps the platform reliable for legitimate streamers.

2.2 What you submit

To complete verification you will be asked to provide: legal or trading business name, country, contact phone number, website or primary social presence, a description of your intended use case, the type of content you will stream, expected peak concurrent viewers, and (optionally) a reason if you are requesting expedited review.

2.3 Automatic signals

At signup and submission time we also record your IP address, derived geographic region, user-agent, and automated risk flags. These signals help reviewers assess the request and are handled as described in our Privacy Policy.

Personally identifiable verification details are automatically purged 90 days after a final decision. Hashed (one-way) identifiers may be retained indefinitely to prevent repeat offenders from rejoining under new accounts.

3. Subscription Plans and Billing

3.1 Plans

The Service is offered through paid subscription plans (Starter, Pro, and Enterprise), plus custom plans created by us for enterprise customers. Each plan includes specific limits on concurrent streams, viewers, storage, bandwidth, team members, recording duration, and features as described on our pricing page.

3.3 Partial payments and account credit

Invoices accept partial payments. Any remaining balance is carried on the invoice until paid in full. We may issue account credit (for example after a pro-rata adjustment or refund) which is automatically applied to future invoices before any external payment is taken.

3.4 Grace period and suspension for non-payment

If an invoice is not paid by its due date, your subscription enters a 7-day grace period during which the Service remains available. We send a reminder near the midpoint of the grace window. If the balance is not settled by the end of the grace period, the subscription is cancelled, active live streams are stopped, stream keys are disabled, and VOD playback becomes unavailable until the account is reactivated.

3.5 Overages and limits

If you approach your plan's limits (for example storage, bandwidth, concurrent viewers, or recording duration) we will email a warning at 80% and 90% thresholds. If you exceed a limit, the Service may restrict additional usage (for example refuse new uploads, cap concurrent viewers, or stop a recording mid-stream) until you upgrade your plan or the current billing cycle resets. Live streams already in progress are not terminated solely because a soft limit is reached. We will not charge overage fees without prior notice.

3.6 Cancellation

You may cancel your subscription at any time through your dashboard. Upon cancellation, your account remains active until the end of the current billing period. After that, your live streams will be stopped, stream keys will be disabled, and your VOD library and recordings become inaccessible to viewers. Your content is retained for 30 days before deletion, during which time you may resubscribe and pick up exactly where you left off.

The content type and use case you provide during verification are binding. Materially changing the nature of your streaming (for example pivoting from educational content to adult content, or from a single channel to a reseller model) requires a new verification review. Operating outside your approved category may trigger suspension.

5. Account Suspension, Ban, and Termination

5.1 Suspension

We may suspend your account, with or without prior notice, if we reasonably believe that you have violated these Terms, that your content is causing immediate harm, or that your account is being used to abuse the Service. While suspended, your live streams are stopped, stream keys are disabled, VOD playback is blocked for viewers, and you cannot publish or upload. You will continue to have read-only access to your dashboard so that you can contact support, export data, or settle any outstanding balance.

5.2 Ban

For serious or repeated violations, or where safety requires it, we may ban an account outright. Banned accounts lose access to the dashboard, and the individual(s) responsible may be prevented from registering new Fynstream accounts via hashed-identifier signals described in our Privacy Policy.

5.3 Reinstatement and appeals

If you believe a suspension was made in error, you may appeal by contacting us at the email address in Section 16. We respond to appeals within a reasonable timeframe and may request additional verification information before reinstating access.

6.1 Ownership

You retain ownership of all content you stream, upload, or create through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to store, process, transcode, thumbnail, deliver, and distribute Your Content solely for the purpose of providing the Service to you and your chosen viewers.

6.2 Responsibility

You are solely responsible for Your Content and the consequences of streaming or publishing it, including clearing any third-party rights (music, footage, talent releases). We do not endorse or assume liability for any user content. We reserve the right to remove, restrict, or refuse to deliver content that violates these Terms.

6.3 DMCA and copyright

We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe your copyrighted work has been infringed, please contact us at info@fynstream.com with the required DMCA information (identification of the copyrighted work, the allegedly infringing URL, your contact details, a good-faith statement, and a signed statement under penalty of perjury). Repeat infringers will have their accounts terminated.

6.4 Content retention

Recordings generated from live streams are subject to plan-specific maximum durations (for example, 30 minutes on Starter, 2 hours on Pro, 8 hours on Enterprise). When a recording reaches its duration limit it is finalized and uploaded to your VOD library; the live stream itself continues uninterrupted. Only original uploads count against your storage quota; platform-generated transcodes do not.

7. Streaming, Delivery, and Viewers

7.1 Stream visibility

Each stream can be set to public (listed), unlisted (accessible only via the direct link), or password-protected. You are responsible for the distribution of unlisted links and passwords.

7.2 Embeddable player

The Service provides an embeddable video player for use on your websites and applications. You may customize the player appearance within the options available on your plan. You may not modify, reverse engineer, or remove Fynstream branding from the player beyond the customization controls we provide. Embeds may be restricted to specific domains via the domain whitelist feature, and HLS playback URLs are cryptographically signed and short-lived.

7.3 Bot and abuse protection

Public watch pages and login flows are gated by Cloudflare Turnstile. By accessing these pages you consent to the Turnstile challenge and the limited data Cloudflare processes to complete it.

7.4 Geographic restrictions

You may restrict playback of your streams by country. We do not guarantee perfect geographic accuracy; IP-based geolocation is inherently approximate.

7.5 Viewer conduct

Viewers watching your streams must also comply with these Terms. Chat messages (where enabled) must not contain harassment, threats, hate speech, illegal content, or spam. As the streamer you are the primary moderator of your own chat.

8. API and Integrations

Access to our API is subject to rate limits, permission scopes, and features defined by your subscription plan. API keys are confidential, must not be shared publicly, and must not be embedded in client-side code. We reserve the right to revoke API access for abuse, credential leakage, or violation of these Terms. Webhook endpoints configured by you are your responsibility to secure.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information (including verification data, content, analytics, and viewer metrics). By using the Service, you consent to the data practices described in the Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by law, Fynstream shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Fynstream, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms or the Service will first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

14. Changes to These Terms

We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the Service. Your continued use after the effective date constitutes acceptance of the updated Terms. If you disagree with changes, you may cancel your subscription before the changes take effect.
